Except for certain kinds of disputes described in Section 16, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND PRISTINE GAZE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract. Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. (See Section 15.)

• Pristine Gaze offers a 14-day money-back guarantee for new subscribers only. If you are not satisfied with our service, you can request a full refund within 14 days of your initial subscription purchase.
• To request a refund, contact our customer support at info@pristinegaze.com within the 14-day period.
• After the 14-day period, subscriptions are non-refundable and there are no refunds or credits for partially used periods.
• Pristine Gaze reserves the right to change the terms of this refund policy at any time.

6. Licences: 

• Subject to these Terms, Pristine Gaze grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for your personal, non-commercial use.
• You may not use, copy, adapt, modify, prepare derivative works based upon, distribute, licence, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Service or any portion thereof, except as expressly permitted in these Terms.

• PRISTINE GAZE DOES NOT WARRANT THAT THE SERVICE OR ANY PORTION OF THE SERVICE, OR ANY MATERIALS OR CONTENT OFFERED THROUGH THE SERVICE, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND PRISTINE GAZE DOES NOT WARRANT THAT ANY OF THOSE ISSUES WILL BE CORRECTED.
• NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICE OR PRISTINE GAZE ENTITIES OR ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SERVICE WILL CREATE ANY WARRANTY REGARDING ANY OF THE PRISTINE GAZE ENTITIES OR THE SERVICE THAT IS NOT EXPRESSLY STATED IN THESE TERMS.

• TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE PRISTINE GAZE ENTITIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE OR ANY MATERIALS OR CONTENT ON THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ANY PRISTINE GAZE ENTITY HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.
• EXCEPT AS PROVIDED IN SECTION 16 AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE PRISTINE GAZE ENTITIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (I) THE AMOUNT YOU HAVE PAID TO PRISTINE GAZE FOR ACCESS TO AND USE OF THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT OR CIRCUMSTANCE GIVING RISE TO CLAIM; OR (II) $100.
• EACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO AND DOES ALLOCATE THE RISKS BETWEEN THE PARTIES UNDER THESE TERMS. THIS ALLOCATION IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER PROVISIONS OF THESE TERMS. THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

14. Indemnity:

• You agree to defend, indemnify and hold harmless Pristine Gaze and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of: 

i) your use and access of the Service, 

ii) your violation of any term of these Terms, 

iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right, or 

iv) any claim that your use of the Service has caused damage to a third party.

• This defence and indemnification obligation will survive these Terms and your use of the Service.

15. Dispute Resolution and Arbitration:

• Any dispute arising from these Terms and your use of the Service shall be governed by and construed and enforced in accordance with the laws of Delaware, United States, without regard to conflict of law rules or principles.
• The tribunal will consist of one arbitrator. The place of arbitration will be Delaware, USA. The language to be used in the arbitral proceedings will be English.
• Judgement upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. 
• `You and Pristine Gaze agree that any arbitration shall be limited to the dispute between Pristine Gaze and you individually. To the full extent permitted by law, no arbitration shall be joined with any other; there is no right or authority for any dispute to be arbitrated on a class-action basis or to utilise class action procedures; and there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
